well i'm getting ready to record some video of me doing some card tricks (some from Dan and Dave, Wayne Houchin, ext.) and post them up on myspace. Is that illegal?

Technically, performing anybody elses trick is illegal without getttting permission from them so yes and no because they really don't care lol.

pretty sure its not illegal unless your performing it on nationalized television, anything in the line of online vids, myspace, local tv, etc is fine (albeit a bit rude) without permission as long as its original footage. that is why so many youtube tutorial's survive. as of now there is no legal way to prevent this as their is no way to gain intellectual proprietary rights to a magical method only the footage on which you have taught it originally.

In the U.S., copyright law only protects works that are fixed in a tangible medium of expression ( Meaning dont take a clip from a DVD and use that or you are breaking the law)

Technically its not illegal to share knowlege via Youtube. Which for magic I friggn hate it. I diss people on their pages for informing the public about tricks and the explination. I think its really up to the person performing in the video to have the code of conduct as a Magician to not expose secrets.

Always respect the creators of your tricks before performing and I would try to avoid using a popular song in the video.

agreed on it being the magician's responsibility to have the decency to do the right thing and the respect to honor those who's material they are using however i think it should be just a well chosen choice of music, doesn't matter if its popular or not as long as it fits the video.

Yea, but there have been alot of cases where youtube kills the audio of the video if it breaks copyright law. I wouldn't even bother using a song unless its in the public domain for free use.

mabe if he just riffles the cards as a audio recording he will be safe hehehe :D

okay thanks for all the help! :) i will just post me doing the card tricks (if i can do em right lol) and at the end of the video just say special thanks to dan and dave, wayne houchin, ext.. i also don't know if to put the name of the tricks i'm afraid some ppl might look them up on google or something and get exposed :(

A simple name of the magician is all you need. No need to name the tricks down for everyone. :)
